Legal Basis Governing Lane Hogger?

From the perspective of traffic rules on the highway, the act of lane hogging is a violation of traffic regulations. Particularly violating Article 108 paragraph (2) of Law No. 22 of 2009 concerning Traffic and Road Transportation, which states, “The use of the right lane can only be done if (a) the driver intends to overtake the vehicle in front of him, or (b) ordered by an officer of the Republic of Indonesia National Police to be temporarily used as the left lane.”

In addition, the act of lane hogging also violates Article 41 point (b) of Government Regulation No. 15 of 2005 which states, “The right traffic lane is only intended for vehicles moving faster than vehicles in the left lane, in accordance with the established speed limits.”

For drivers on the highway, it is mandatory to drive their vehicles in accordance with the speed limits set out in Article 3 paragraph 4 of Minister of Transportation Regulation No. 111 of 2015 which states, “The minimum speed limit on the highway is 60 kilometers per hour and the maximum is 100 kilometers per hour.

If a driver engages in lane hogging on the highway, they will face a maximum prison sentence of one month and a fine of up to Rp250,000. This is in accordance with Article 287 paragraph 3.
